for the Use of the Security Jobs Network® Web Site.

WELCOME TO SECURITYJOBS.NET, OWNED AND OPERATED BY SECURITY JOBS NETWORK, INC. (“SJN”). PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEB SITE (the “SJN SITE”).

BY USING THE SJN SITE, YOU ARE INDICATING YOUR ACCEPTANCE TO BE BOUND BY THE TERMS OF THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THE TERMS AND CONDITIONS STATED HERE, DO NOT USE THE SJN SITE. The terms “You” and “User” as used herein refer to all individuals and/or entities accessing the SJN Site for any reason.

SJN, its related companies, affiliated organizations and/or divisions retain the right to revise these terms and conditions at any time. Any use of the SJN Site in violation of these terms and conditions constitutes trespass and/or infringement of the rights of SJN and/or its sponsor(s) and may result in legal action against you.

Site Usage

The SJN Site may be used only for lawful purposes. Users may not use the SJN Site in order to transmit, distribute, store or destroy material: (a) in violation of any applicable law or regulation; (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others; or, (c) in a manner which is libelous, obscene, threatening, abusive or hateful.

Registered Users of the SJN Site authorize SJN to gather employment research information on their behalf from a variety of both online and offline sources. This information is placed in the password-restricted area of the SJN Site for their individual use in aiding or facilitating their personal job search and/ or their personal research of employment related information.

If you have access to a password restricted area of the SJN Site, you shall not share or disseminate your password, and you shall not share or disseminate the information contained in the protected areas of the SJN Site to other individuals, entities, groups or web sites without the express permission of SJN.

You shall not copy or adapt the HTML code that SJN created to generate pages on the SJN Site. The HTML code also is subject to copyright protection.

Trademark Information

SECURITY JOBS NETWORK is a registered service mark of SJN, SECURITYJOBS.NET, SECURITYJOBSNETWORK.COM, SECURITYJOBSNETWORK.ORG, SECURITYJOBSNETWORK.INFO, SECURITYJOBSNETWORK.BIZ, SECURITYJOBSNETWORK.US and the SJN Logo Designs are trademark or service marks of SJN.

SJN also has trademark protection for the “look and feel” of the SJN Site. Elements of the “look and feel” or “trade dress” for the SJN Site include SJN’s color combinations, button shapes, layout, and all other graphical elements not the property of third parties.

All third party trademarks and tradenames are the property of their respective owners.

Responsibility

SJN has no obligation to monitor the SJN Site, but reserves the right to do so. SJN bears no responsibility for the accuracy of any materials provided by others and not prepared by SJN. User acknowledges and agrees that SJN is not responsible for the content of any other Web Sites linked to the SJN Site; links are provided as Internet navigation tools only. SJN does not warrant or guarantee that any specific number of Users shall view a job description or that any specific User will view it. SJN does not guarantee the availability of a researched opportunity listed on the SJN Site.

Subscribers Area

SJN endeavors to provide and maintain the SJN Site to assist Users in identifying employment opportunity information for positions that fit our stated criteria. SJN will make available access to the password restricted area of the SJN Site for the specified agreement period upon registration and receipt of payment for the then-applicable service fee.

SJN reserves the right, at its sole discretion, to immediately suspend or terminate without notice your ability to access the password restricted area of the SJN Site, upon any breach by you of these Terms and Conditions or if SJN is unable to verify or authenticate any information you submit to the SJN Site.

(1) Submission of false or misleading information by you to SJN for any reason whatsoever; and/or (2) use of your password to gain access to the password restricted area of the SJN Site by individuals other than you: constitutes a violation of these Terms and Conditions. Such actions may also constitute violations of the federal Computer Fraud and Abuse Act (18 USC §1030), the federal Stored Communications Act (18 USC § 2701), the Virginia Computer Crimes Act (Va. Code §18.2-152.1 (et seq.)), and/or other applicable law, and may subject the violator to civil damages, criminal fines and/or imprisonment.

SJN reserves the right, at its sole discretion, to restrict without notice your ability to access the password restricted area of the SJN Site, if SJN in good faith believes that you have shared or disseminated your password to other individuals, entities, groups or web sites in violation of these Terms and Conditions.

Any User whose access is suspended or terminated for cause for violation of the Terms and Conditions as set forth herein, forfeits all rights to a refund in part or in full of any monies paid to SJN for services.

Web Site Security Rules

Users are prohibited from violating or attempting to violate the security of SJN, including, without limitation from:

a. accessing data not intended for such User or logging into a server or account which such User is not authorized to access;

b. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;

c. attempting to interfere with service to any User, host or network, including, without limitation, via means of overloading, "flooding", "mail-bombing" or "crashing";

d. sending unsolicited e-mail, including promotions and/or advertising of products or services;

e. forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; and,

f. willfully submitting fictitious or false subscription information whether or not there is an intent to defraud

Violations of system or network security may result in civil or criminal liability. SJN will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

Payment of Invoices

Payment for activation or re-activation of a Subscriber ID and Password is required prior to access being granted to the protected areas of the SJN Site.

Suspension, Termination

SJN reserves the right, at its sole discretion, to immediately terminate or suspend without notice your ability to access the SJN Site, upon any breach by you of these Terms and Conditions or if SJN is unable to verify or authenticate any information you submit to the SJN Site.

Furthermore, any User who submits false, misleading, abusive, obscene, threatening or rude communications via email, postal mail or telephonically in the course of his/her interaction with SJN, its employees or contractors, may at the sole discretion of SJN, forfeit all rights to use the SJN Site.

Privacy

When you register for the SJN Site, you will be asked to provide SJN with certain information including, without limitation, a valid email address (your "Information"). You understand and agree that SJN may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. SJN will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant. SJN reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by SJN or by third parties.

SJN may also use the Information to contact Users about our services and/or keep them informed of their account status or updates to the SJN Site.

Personally identifiable information submitted or posted by individual Users on the SJN Site’s open forum or BBS is not confidential and may be viewed by SJN and anyone with access to those areas on the SJN Site. SJN is not responsible for statements made by third party Users on the SJN Site’s open forum or BBS.

Disclaimer

You use the SJN Site at your own risk. The materials on the SJN Site are provided "as is" and without warranties of any kind either expressed or implied. To the fullest extent permissible pursuant to applicable law, SJN and its affiliates disclaim all warranties of merchantability and fitness for a particular purpose. SJN does not warrant that the functions contained in the material will be uninterrupted or error free, that defects will be corrected, or that this SJN Site or the server that makes it available are free of viruses or other harmful components. SJN does not warrant or make any representations regarding the use of or the result of the use of the material in this SJN Site in terms of their correctness, accuracy, reliability, or otherwise. You (and not SJN) assume the entire cost of all necessary servicing, repair or correction. The above exclusion may not apply to you, to the extent that applicable law may not allow the exclusion of implied warranties.
